Ups, we did it again !

The case of Siti  Hajar in Malaysia  seems  just another number to the already very long list of Indonesian migrant worker cases. The different is  it is happening when Presidential election is soon taking place. The incumbent President had phoned directly to Siti  Hajar as reported by the media. He instructed his sub-ordinates; the head of Placement Board for Placement Protection of Indonesian Overseas Workers (BNP2TKI) and Indonesia Ambassador to Malaysia to bring justice and assist Siti Hajar on this process.  But how about the case Nurul Widayanti (22 th) from village Dindeen in Ngawi or Sumasri of Blitar who is depressed as she worked for two years in Puchong Selangor and her employer, called Atung who has caused her wounds all over her body by throwing hot water.  How about those migrant workers, between 60 to 100 people every month ( in Malaysia )  that face problems as explained  as by KBRI  Secretary II Mr. Susapto Anggoro Broto who stated that Malaysian immigration is no longer easy in providing so called check out memo for those migrant workers who need them badly.  It is obvious that this problem is a systematic and chronic one. I have so many how that need to find answer.  Fair to say then that until Indonesian Government trough its Ministry of Labour and its BNP2TKI absolutely clear on their role to protect migrant workers and the importance of migrant workers in Indonesia economy and not simply see them as milking cow, I am afraid our relationship with Malaysia on this spectrum will stay as it is now. The notion of “Indon” as refer to Indonesia or Indonesian is clearly a derogatory one. I am not going to dwell on the meaning of Indon as one can ask the people directly who call us that way. My point is,  this has been for years now. We let it happened and let our migrant workers and mostly Indonesian continue to be call Indon. Why I said this? First of all I am not sure whether the leaderships in Ministry of Labour or BPN2TKI understood the notion of vulnerability that our migrant workers are place to. They understand that these women migrate because of the livelihood issues but the connection between the two is almost blank. The suffering and cases of abuse are almost take place daily or at least weekly as reported by media but still it fail to address.  Secondly, take a look on our bilateral MoU between RI and Malaysia. Was RI able to defend the rights of its citizen to hold into her passport while she works inside Malaysian household? Many migrant workers become illegal because we make them illegal by not providing an easy and safe way to migrate. When a migrant worker‘s passport keep by her employer or recruitment agency, she is in trapped  and very vulnerably to abuse as if she leave the household when she face abuses from her employer, she can be seen as illegal  from Malaysia point a view.  Thirdly there are many loop holes in the migration track. It is not fair just to point a finger to Malaysian side. It is time to reflect and see how Indonesian government may complicit on this saga of migrant workers. Let examine closer inside Indonesia. The facts on the existence of the practice of dubious recruitment of migrant workers who are mostly women, the existing placement fee and so called “training/holding centres “ within Indonesia   itself, for me, have to be scrutinized. We are aware how the practice of trafficking is often found on this line of work.  If only we have a standard mechanism in which the migration pattern and its patterns of abuse and violation of rights are identified, located and tackled, then the government and its ministry of labour plus its BNP2TKI may say that there is an improvement. If the improvement is only see on a matter of how they are able to send the number of workers overseas this year, the increased of wages, these are very much numeric and not quality of migration, in my opinion. This is just not good enough.   Fourthly, it is fair to ask to ask; have the government and parliament ratify the International Convention on the Protection of All the Rights of Migrant Workers and members of their Family?  The answer is no.  We are signatory in 2004 so what made us stop here and not ratify it? Again, this is a question to our government and parliament members to answer. The founding father and mother’s government back in 1950 had ratified the ILO Convention no 29 on Forced Labour  ( 1950)  a situation of many Indonesian migrant workers are now experienced. The changing from Suharto regime to new government in 1999 has brought the ratification of Convention no 105 on The Abolition of Forced Labour. It is worthy to underline that the current government and the ingoing DPR have failed in giving protection for our migrant workers.  The present Law no 39/2004 on migrant worker has its own problems and not accepted by migrant workers union or solidarity groups as it is seen very much placement rather than protection. Nonetheless the ingoing DPR from 2004 –until now 2009 have failed to re-address the critics on this Law.  Last but not least, it is open and publicly known among us, how many domestic workers inside Indonesia who got acknowledgement of her works, get protection from abuse, get a day off per week like other worker, and get regional minimum wage standard?  Having said all of that, why we are now questioning our relationship with Malaysian?  It is easy to blame others than to seek answer what I have done or I can do to minimize this situation. I believe a more thoughtful and philosophical plus policy change is needed to enable us to answer this. It will not be answered by a Presidential campaign leaflets or promises.

The more recent development from Burma is the fact that  more people fled from Burma after the election that view by many international leaders including President Obama as far from fair and repressive. Indonesia President who hosted President Obama visit to Jakarta, has not made likewise statement on Burma election. In fact few years ago, in one of the discussion forum hosted in LSE (London School of Economics) where President Yudhoyono gave a talk on Indonesia role in the region, there was a question from the floor on how he defined leader and leadership. This event was in conjunction with the meeting of G20 in UK that time.

The question was a valid one as President Yudhoyono gave an impression in part of his lecture, to indicate the military junta in Burma as Burmese leader. The question from the floor was a simple but fundamental one as Burma military junta is not elected. Frankly, I was the one who asked this question, as I wanted to see Indonesia can play a more significant and a firm role in democratisation on the region, including Burma.  Indonesia therefore has an important role to play. How did President Yudhoyono answer to this question can be another discussion.

It is the intention of this writing to bring Burma into the agenda that international leaders should not hide it into the carpet. Especially when the release of nobel laurate Aung San Suu Kyi is a matter of hours or days. Not to mention that world leaders are having G20 meeting in South Korea.

As we all know how Suu Kyi has been holding a pivotal point on democratization of Burma and her struggle has inspired many people around the world. Especially as she keep on track on non violence and stand firm by her principals, sacrificing her own interest including her family as she knows Burmese people put hope on her. She is the universal symbol of courage and perseverance .

President Yudhoyono should aware about these facts of her.  He understood about Burma military junta track record, I suppose. He himself had mentioned that to reform Indonesia military has not been an easy task.

So, Obama ‘home coming’ to Indonesia few days ago has sparked a lots of news. From the infamous ‘hand shake story’ to the ‘Indonesia is a part of me’ buzz word. President Obama visited to some countries in the Asia region including India and Indonesia could have been used as an opportunity to take more firm action to the military junta of Burma, in my opinion. To  give more pressure to the junta to free Suu Kyi.

            Obama did mention Burma in his speech in Indonesia. He also directly questioned Burma election and stated “the voting neither free nor fair, demonstrated the regime’s continued preference for repression and restriction over inclusion and transparency”.

On the ground, 15.000 people fled Burma to the Thai border because of the conflict that takes place between the military junta’s troop and ethic ‘rebels’. Children including babies, women, men, the elderly are among these people who try to escape the clash.  I believe this is not the first one and will not be the last one too if the military junta is still in power.

Meanwhile in Jakarta, there was another important meeting should be noted. The visit of China National People’s Congress chairman, Wu Bangguo to Indonesia should also be highly appreciated.  It goes without saying China and US are important countries to Indonesia.

China has been perceived as the one ‘closing its eyes ‘on the acts of Burma military junta to Burmese people’. In fact some people may think China seems like the ‘guardian ‘of this Burma military junta, to balance the power of India which is also a neighbour of Burma. Burma used to be a great nation and it has been declining since the military junta in power. Indonesia as named itself as a democratic country which used to be rule under the “Dwi Fungsi/ Double Roles” of ABRI/ military  can was seen as one of the lesson borrowed and picked up by Burmese military junta, is indebted to facilitate the  emerging democratic process in Burma. Indonesia can do this role if it focus and determine to do so.

Why Indonesia can do this significant role? It is simply because Indonesia is very strategic, both to China and also USA.  This may sounds to simplistic but a good idea tend to be a simple but a rooted one. Indonesia should be able to persuade China on the benefit of democratic Burma. What is the point of China major leap to influence and has a grip in African continent through major investment and business there if China cannot master its influence in Asia region through a peaceful, democratic and in elegant ways?

It has already signal by the China parliamentarian on his visit this week to Indonesia. Bangguo use the term “deepening mutual political trust” on China-Indonesia relation. I hope this is not only a rhetoric and therefore Indonesia should address one of the major issue that has been like ‘pebble of the shoes’ of ASEAN and ASEAN Plus 8 as well is the fact that Burma military junta will not change and does not have good intention to change fundamentally to a better and a democratic system. Simply it will not serve any interest to them as a military junta. Voluntary change should never be expected from this type of government. Military junta type of government in the 21st century is a model of government that should perish and not promoted. Indonesia can spread this point and have a mutual dialogue with China.  Indonesia should have equal dialogue about Burma with China and USA while the leaders were hosted in Jakarta.

Indonesia leaders should use this framework of deepening mutual political trust and ask China to re-asses its position and policy towards Burmese military junta. Indonesia should enable the Chinese leaders to see how the military junta in Burma has become liability on the new global world and China should dismantle its connection to this military regime of China truly want to be respected leader of the region. Respect is earned, not come as a free raider. Not feared which is not associated to a true leadership.

Dialogue does not have to be a preaching or with a patronizing tone one. The first visit Prime Minister David Cameron of UK to China recently has shown these skills of diplomacy and dialogue. PM Cameron brought the biggest UK contingent including business and trade people to China few days ago. Yet he was able to set a right tone when he called China on the importance of greater political freedom inside the country. Here, he did not mention for the immediate release of the latest Nobel Peace winner, Mr. Liu Xiaobo in public speech, which to me personally I viewed this as discouraging sign. Although he stated that his visit was not about ‘lecturing or hectoring’ of China government. To be fair, he was able to express his view that ‘the best guarantor of prosperity and stability if for economic and political progress to go in step together’. He persuaded China to play a greater role in international affairs as China is very important. On the other side he urged China for the importance of the rule of law and free press.  Why Indonesia could not talk with similar tone to China, to persuade China to seriously re-asses its policy towards Burma military junta when China has already opened the discourse of deepening mutual political trust to Indonesia. Trust is the basic for real dialogue. Why Indonesia does not taste this water of trust between the two countries to discuss why Burma ought to be a democratic country and the military junta of Burma does not part of the picture has they have failed many times, the last one was the unfair election.

The illustration from the two world leaders, UK and USA should have given President of Indonesia a clear idea that it would not be counter productive to bring issue democratization of Burma as a serious and must be dealt immediately.

It is up to President of Indonesia to bring up this agenda and to promote Burma issue in every possible ways and forum. He can seize this opportunity to increase his leverage as a leader of big nation in the region and also to promote the idea of civilian supremacy. Indonesia has this capacity as soft power in the global world.  He may not see the end result of this effort on his presidency term, but any steps to minimise the power of undemocratic regime will be appreciated not forgotten. As he is now in G20 meeting, I hope he seizes this opportunity.

So, he can also genuinely welcome the release of Suu Kyi from house arrest and one day if he meets her personally, he can have a mutual dialogue and can face her as he did something when she was detained. As to Suu Kyi as I remember her prim wit and gentle ways when we had tea in her house years ago. She has been unbending person and committed to her cause. Once she said that her release should not bee seen as a major breakthrough for democracy as she viewed only when the people of Burma enjoy basic freedom then we can salute the real democracy is there. Nonetheless, let us cheers for your release, an important step to a better – democratic Burma.

BEYOND ACADEMIC

 

            I have gained experiences and knowledge in my first year in University of Edinburgh.  This year Edinburgh is among the best 20 Universities in the world. As a postgraduate student in Divinity school, I am lucky as I am located in a spectacular and historical New College building which is not new at all. It is located on the mound, near to the Royal Miles. In fact, my working station is just about two minutes walk to Edinburgh castle. Being here has open tremendous opportunity for me to absorb many events, from celebration of 150 years DarwinOrigin of Species to Sherlock Holmes and more to come. Indeed, it is a golden opportunity.

            It was not an easy process for me to start PhD study at University of Edinburgh. I had aimed for it and have this incubation process in my mind for about four years. I worked hard to get scholarship from my government .I had to move from the capital city Jakarta to provincial city of Yogyakarta for about  eight months as a process of chasing for the scholarship. I have to resign from my job in the national parliament (DPR RI) as expert staff and brought my son to move to Yogyakarta which then would make me eligible for the scholarship.

Certainly it was hard for my four years old son, to be away from his beloved Opung ( Grand Ma), leave his very good nursery in Jakarta and try to fit in into new nursery, new house and new city.

I had to use my own saving to support me and my son when we lived in Yogyakarta. I was adamant to do my study in University of Edinburgh. I am aware about the quality it has to offer. In the back of my mind, I was also aware on the added value that Edinburgh univerity has.

 For me and as far as I can remember, University of Edinburgh has its reputation and as it is located in such beautiful city, to be student here is beyond academic  per se. It was a big relief when I saw my name in the list of Directorate of Higher Education (DIKTI) of Ministry of Education. I got the scholarship.

Starting from the beginning, the process was not as  smooth as I thought.  I have this delayed in my student visa application and I tried many things to foster the process of obtaining student visa, including writing a letter to UK Ambassador to Indonesia for my visa inquiry. It was supposed only to take 3 to 5 working days but it went further becoming a month with out clarity. It was very frustrated as I have been to UK so many times and also other countries.

            Again, something happened on this visa application. I have a great supervisor who went extra miles when he heard that I have not arrived in Edinburgh due to visa delayed.  He offered me to write a letter to UK embassy in Jakarta. He even offer to write to his MP so that the MP can write to UK embassy in Jakarta that they should not keep my visa application in limbo as the academic term has started and I was late for a month!

            This type of support is not in administration level per se. It went to the personal level. I found out that my supervisor is actually a truly kind and understanding person. He understood that I am also a full time mother and it was not easy to find child care when you arrived late in the university. He understood in several occasion that I have to take my child with me as there is no child minder available and I have not got a place in nursery as well. In fact, I found some other lecturers were also accommodative.  I wonder how can these kind caring lecturers gathered in the same place namely University of Edinburgh. Is it merely by chance or the act of Divine Providence in helping m situation?

            In Financial level, I find people in Registry office are also accommodating. I have no difficulties to explain my financial situation which will only allow me to pay my tuition fee in several disbursements as it will follow the disbursement of my sponsor.  When I paid my first instalment for the fee, I did not know when the next instalment is going to be. I only vaguely said it can be February or maybe March or the latest on April the following year. I simply do not know as it will depend on the national budget disbursement system in my country. I am aware that 2009 is the year of national election in Indonesia, for congress, senate and president as well. Basically many things will be postponed including national budget appraisal and disbursement. Possibly my scholarship, be influenced and caught on this process. Not to mention the natural calamity, earthquake that hit many provinces in my country will also affect the priorities of the government.

            The Registry and Finance office seem to understand my situation. It was not an easy one to explain but it was not also very difficult either. This is one of the things I really like about University of Edinburgh. It has this openness to reason. Not merely academic reasoning but it went deeper, to facilitate the diversity of problems, challenges that its students have to tackle. Once again, the service provider has act beyond academic or business. There is a sense of empathy towards student situation.

As a student it was my first time experience to elect a university rector. It was fascinating. I went to website of the candidates and it was very important experience for me as I can see how the voting system are and I just love the idea that I was an active participants in the rector election. It has added my sense of belonging to the university.

            The intellectual atmosphere with a friendly gesture is my impression of University of Edinburgh. There are always interesting public lecturers which are free. One just needs to get a ticket. The list of speakers are very long and diverse, from the grandchild of Mahatma Gandhi, Mr. Arun Gandhi who talked about non violence and prejudices, lecturers on China and its new development as part 60 anniversary of Republic of China to Gifford Lecturer which this term year will focus on theme namely Free: The Science of Mind Constraining Matter which will be delivered by Prof. Michael Gazzaniga. Edinburgh as a city also famous for its beauty and festivals. Last August, in Edinburgh International Book Festival I was able to meet Richard Dawkins the famous atheist in the world and there werealso session with Anthony Giddens and Cherie Blair, to name the few.The intellectual atmosphere with a friendly gesture is my impression of University of Edinburgh and I guess in UK universities at large.

One of very importance feature to me is the fact that the University also has Disability Office. The Disability Office support students with a wide range of impairments and difficulties including dyslexia, autism, sensory and mobility impairments, mental health problems and medical conditions such as diabetes and asthma. The list on positive things is endless. There is also International Office which caters the needs of International student and Chaplaincy centre which open to multi- faith religious based. All of these qualities have provided students a balance life. Fun, caring and intellectually proven university is one amongst many others reason to study in UK. One can also see other European cities in the Europe continent during holiday season as airline ticket is fairly cheap as long as one plans ahead.

            Having said the experiences and benefits that I have enjoyed by studying in United Kingdom, I need to put one point more. It is about the network that I gained from studying in UK. I have developed a social capital and I think this will endure and influence my future, in work level and personal level. Well, I hope one will be intrigued and come to UK to study or even for a visit.
